Terms & Conditions

1. Membership & Eligibility

Membership to Nganyuthe Water Project is open to any resident or landowner within the project service area. Members must complete the registration process, pay the required onboarding and connection fees, and agree to abide by these terms and conditions and all project bylaws.

2. Water Connection

Each registered member is entitled to one water connection per registered property. Additional connections require separate registration and payment of applicable fees. The water connection remains the property of Nganyuthe Water Project and may not be transferred, sold, or modified without written consent.

3. Payment Obligations

Members are required to pay their monthly water bills by the 15th of each month. Late payments attract a penalty as determined by the Board of Management. Failure to pay for three or more consecutive months may result in disconnection. Members in arrears may apply for a payment plan subject to board approval.

4. Water Use

Water supplied by the project is for domestic use only. Commercial use or resale of project water is strictly prohibited without prior written authorization. Members must not waste water or engage in activities that contaminate the water supply.

5. Meter Reading

Meters are read monthly by authorized project staff. Members are required to ensure their meter is accessible for reading. Tampering with a meter or interfering with a meter reading is a serious violation that may result in disconnection and legal action.

6. Maintenance Responsibility

The project is responsible for maintaining the main pipeline and the meter. The member is responsible for maintaining all plumbing within their property from the meter point. Members must report leaks promptly and may be charged for excessive water loss due to internal leaks.

7. Disconnection & Reconnection

The project reserves the right to disconnect water supply to members who violate these terms. Reconnection is subject to settlement of all outstanding amounts plus the applicable reconnection fee, and approval by the Board.

8. Amendments

These terms and conditions may be amended from time to time by the Board of Management. Members will be notified of any changes via SMS, notice boards, or the project website. Continued use of water services after notification constitutes acceptance of the revised terms.

9. Governing Law

These terms are governed by the laws of Kenya. Any disputes arising from these terms shall first be subject to internal dispute resolution mechanisms before being referred to the appropriate legal authorities.
